Len Bunton, Chair of the Steering Group of the Conflict Avoidance Coalition, and Neil Kelly of MFMac discuss disputes in the construction sector and the work of the Coalition.
Matters touched upon include :
- CICV 2024 research showing bad payment practices are still rife in the Scottish construction industry
- the new revised Fair Payment Code published by the UK Government in early December 2024
- the Conflict Avoidance Coalition ( CAC) with 86 industry bodies and organisations involved
- the CAC Mission Statement and Pledge - the aim that conflict avoidance mechanisms are to be included in all construction contracts
- the CICV Best Practice Guide for contractors
- the impossibility of eradicating disputes entirely but they should be minimised with adjudication being available to the sector should a dispute need formal determination.
- Adjudication Society/ Kings College, London research in 2024 which demonstrates the success of adjudication and that its use is increasing
- A new generation of adjudicators is coming forward and the need for them to be of appropriate quality through experience and training
