The breakdown of a relationship doesn’t always run smoothly or by agreement, and sometimes court proceedings are necessary. Most people will never have had to be involved in such proceedings before. Our specialist family litigators will support and guide you through that process.

Divorce actions, child orders and cohabitation claims

Are you destined to litigate your relationship breakdown/divorce?

You may find yourself served with a Summons or an Initial Writ or you may be the one instructing service of a Summons or Initial Writ. Either way - you will want to have confidence in who you instruct to represent your interests in those proceedings.

At MFMac, we will give you clear advice on how to respond to, or progress with, court proceedings. We will provide you with direct guidance on strategy including striking the proper balance between cost and benefit. This ensures that your position is advanced both robustly and sensibly.

Our Family Law team are expert litigators who are highly experienced in helping clients navigate the process. We will adopt a holistic approach to your case which we believe secures the best outcome for you.

Representation in litigated actions

We also offer the services of our in-house Solicitor Advocate who has higher rights of audience in UK civil courts and is skilled in court advocacy both in the Court of Session and the Sheriff Court.

A Solicitor Advocate is a solicitor who has undertaken a course of additional training and examinations in evidence, pleadings (written case in court proceedings) and advocacy. They have an enhanced understanding of the court process.

Our in-house Solicitor Advocate can be instructed to represent you as part of the court proceedings or instructed on an ad hoc basis depending on your particular circumstances. Whichever way, the opportunity to be represented by someone who has an enhanced understanding of the court process is available to you.

We also work closely with the most esteemed Junior and Senior Counsel (also known as "Advocates") in Scotland and England. Advocates are external, independent (self-employed) specially trained solicitors. At MFMac, you will benefit from being able to choose how you are represented.
