We regularly provide partners with advice about their rights under partnership agreements or, where no agreement exists, under the Partnership Act 1890 and the common law. We have in-depth experience mediating disputes between partners and arguing partnership disputes in court.
Dissolution of partnerships can lead to particular difficulties including those relating to partnership property and a proper division of assets on dissolution. We also have significant experience pursuing actions of accounting in relation to partnership assets and taking preventative action such as interim interdict proceedings in relation to the use of partnership assets by former partners.
Where partnerships have broken down, we have extensive experience of advising on the insolvency and restructuring of partnerships and have acted in contentious petitions for the appointment of judicial factors to partnerships.
