Joanne is a legal director within our Real Estate and Infrastructure team in Glasgow and part of our Property in Pensions team.
As a commercial real estate lawyer with nearly twenty years' experience Joanne has extensive experience in all aspects of commercial real estate. However she particularly specialises in real estate matters for commercial property SIPP providers and SSAS providers.
Joanne is also dual qualified and as such also advises clients in commercial property transactions in England and Wales.
With the introduction of the Register of Persons Holding a Controlled Interest in Land (in terms of The Land Reform (Scotland) Act 2016 (Register of Persons Holding a Controlled Interest in Land) Regulations 2021) we are seeing many SIPP and SSAS trustees (who could be affected by this legislation) checking their title deeds to ensure that they are compliant with the new rules. This has led to a number of trustees considering whether, in the event there have been changes in trustees within the SIPP or SSAS, it would be beneficial to make changes to the title deeds.
As I start to prepare my report to clients on the investment property they are about to purchase I am conscious that it's important to keep access and egress rights in mind, not only to get to the property but to get out of it, including in the case of fire.
In many ways the legal systems of Scotland and of England and Wales are quite different, largely because they derive from different origins. Property law is no exception to this although, over the years, despite the different underlying laws, similar commercial approaches have been taken on real estate deals both north and south of the border.
From our offices we serve the whole of Scotland, as well as clients around the world with interests in Scotland. Please complete the form below, and a member of our team will be in touch shortly.
