Lynsay's focus is primarily commercial disputes in the Court of Session and Sheriff Courts.
In particular, contract disputes, property litigation and intellectual property disputes. In addition, she is regularly instructed by commercial clients in the defence of a variety of employer and public liability personal injury and industrial disease claims. Lynsay regularly advises on a range of alternative dispute resolution such as mediation. She is an accredited mediator and a member of the Property Litigation Association. Lynsay sits on the firm’s Corporate Social Responsibility group, helping to coordinate pro-bono activities and fundraising within the firm.
Lynsay is instructed in a variety of energy-related disputes. Recent instructions include advising wind farm developers and funders in relation to property damage and access rights claims, as well as a neighbouring landowner’s water rights claim. She is also instructed by a Green Energy company in relation to a complex contractual dispute with investment consultants.
No trustee wants to find their charity at risk of insolvency. Unfortunately, it can and does happen, and trustees must be live to the possibilities of insolvency and take appropriate advice at the first sign of financial difficulty.
