Martin is an Associate within the Litigation & Dispute Resolution team.
Martin has advised on and currently has a diverse caseload covering commercial disputes (including company/shareholders disputes), fraud-related debt recoveries (pre and post insolvency), judicial reviews, and both corporate and personal insolvencies.
He also has experience in intellectual property disputes, including trade mark and patent disputes. He also benefits from experience in IT-related disputes. Martin has advised and continues to advise a wide range of clients, including private businesses, charities, public bodies, and regulators.
Martin is capable of analysing highly complex litigation matters and providing clear options for their resolution. Martin is dedicated to achieving favourable outcomes for clients, employing a strategic and client-focused approach. He has had experience in a wide range of disputes both in the Court of Session and the Sheriff Court. He appears regularly in the Sheriff Court on behalf of clients on both procedural and substantive matters.
A recent decision of the Sheriff Court at Edinburgh amounts to a precedent on the discrete but important question of when decrees in absence become decrees in foro contentioso and thus res judicata on the questions which were referred for judicial determination by a pursuer.
